1. Purpose
These General Terms and Conditions of Sale (the “Terms”) govern the contractual relationship between HERE. (operated by MOJO Creations by Kelly Wagner), a company registered in Luxembourg and operating the website www.here-the-brand.com
(the “Website”), and any individual making a purchase through the Website, including the purchase of digital gift cards (the “Client”).

2. Acceptance of Terms
By placing an order through the Website, the Client unconditionally agrees to be bound by these Terms.

3. Products and Services
3.1 The characteristics, sizes, and specifications of products offered for sale are clearly described on the Website.
3.2 Digital gift cards are subject to the specific conditions set forth in Section 9.

4. Orders
4.1 Any order is deemed final upon payment confirmation.
4.2 If a product becomes unavailable after confirmation, the Company will notify the Client and refund the amount paid within fourteen (14) calendar days.

5. Prices
5.1 Prices are listed in euros and include applicable VAT pursuant to Luxembourg law.
5.2 Delivery charges, if any, are communicated prior to order confirmation.

6. Payment
6.1 Payments must be made using the secure methods available on the Website.
6.2 Orders must be fully paid at checkout.

7. Delivery and Fulfillment Partners
7.1 Products are delivered to the delivery address provided by the Client at checkout.
7.2 The Company may use authorized logistics partners within the European Union to process and ship orders.
7.3 For deliveries to Slovakia, Czech Republic, Poland, Hungary, Slovenia, Croatia, Serbia, and Bulgaria, fulfillment and delivery services are handled by the Company’s authorized regional distributor:

7.4 For all other EU countries, orders are dispatched from EU-based logistics centers.
7.5 Delivery times are estimates and do not constitute a contractual commitment. The Company shall not be held liable for reasonable or unavoidable delays.
7.6 Risk of loss remains with the Company until delivery to the Client’s designated address.

8. Right of Withdrawal
8.1 In accordance with Luxembourg and EU consumer law, the Client may withdraw from the contract and return products within fourteen (14) calendar days of receipt, except in the case of personalized or customized items or digital gift cards that have been used or damaged.
8.2 Return shipping costs are borne by the Client unless the product is defective or delivery errors are attributable to the Company.
8.3 Refunds are issued within fourteen (14) days of receipt of returned goods.

9. Specific Terms for Gift Cards
9.1 Gift cards may only be redeemed on the Website.
9.2 Validity: twelve (12) months from the date of purchase.
9.3 Non-refundable and not exchangeable for cash unless legally required.
9.4 In case of loss or theft, gift cards will not be replaced.
9.5 If the full value is not used, the remaining balance stays valid until expiry.

10. Warranty and After-Sales Service
All products benefit from the legal warranty of conformity and hidden defects under Luxembourg and EU consumer protection law. Claims must be submitted to the Company at info@mojo-creations.com

11. Personal Data
Personal data is processed in accordance with the Company’s Privacy Policy available at www.here-the-brand.com/privacy-policy

The Company and its authorized partners may process limited order information solely for the purposes of order fulfillment.

12. Liability
12.1 The Company’s liability is limited to the amount paid by the Client for the relevant order.
12.2 The Company cannot be held liable for circumstances outside its reasonable control, including force majeure events.

13. Governing Law and Jurisdiction
13.1 These Terms are governed by the laws of the Grand Duchy of Luxembourg.
13.2 Any dispute shall fall under the exclusive jurisdiction of the courts of Luxembourg City.
