1. Purpose

These General Terms and Conditions of Sale (the “Terms”) govern the contractual relationship between HERE. (MOJO Creations by Kelly Wagner), the operator of the website www.here-the-brand.com (the “Website”), and any individual making a purchase through the Website, including the purchase of digital gift cards.

2. Acceptance of Terms

By placing an order through the Website, the Client unconditionally agrees to be bound by these Terms.

3. Products and Services

3.1 Products: The characteristics and specifications of products and services offered for sale are clearly described on the Website.

3.2 Gift Cards: Digital gift cards are subject to specific conditions set forth in Section 9 of these Terms.

4. Orders

4.1 Any order is deemed final upon confirmation by the Client and successful payment validation.

4.2 Availability: In the event that a product becomes unavailable after an order has been confirmed, the Company will inform the Client without undue delay and issue a refund within a maximum period of fourteen (14) calendar days from the date of notification.

5. Prices

5.1 All prices are listed in euros and include value-added tax (VAT) as applicable under Luxembourg law.

5.2 Any applicable delivery charges will be clearly indicated prior to the Client's final confirmation of the order.

6. Payment

6.1 Payment must be made using secure methods as indicated on the Website.

6.2 All orders must be paid in full at the time of order confirmation.

7. Delivery

7.1 Products shall be delivered to the address provided by the Client at the time of ordering.

7.2 Delivery times are provided for information purposes only and do not constitute a contractual commitment. The Company shall not be held liable for delays in delivery.

8. Right of Withdrawal

8.1 In accordance with Luxembourg consumer law, the Client has the right to withdraw from the purchase within fourteen (14) calendar days of receipt of the product, except in the case of personalized items or gift cards that have been partially used or damaged.

8.2 The Client shall bear the cost of returning the goods, unless the return is due to a defective product or a delivery error attributable to the Company.

9. Specific Terms for Gift Cards

9.1 Use: Gift cards may only be redeemed on the Website.

9.2 Validity: Gift cards are valid for twelve (12) months from the date of purchase.

9.3 Non-Refundable: Gift cards are non-refundable and may not be exchanged for cash, except where required by law.

9.4 Loss or Theft: In the event of loss or theft, gift cards will not be replaced.

9.5 Partial Use: If the total value of an order is less than the value of the gift card, the remaining balance can be used on a future purchase.

10. Warranty and After-Sales Service

10.1 All products sold are covered by the legal warranty of conformity and the warranty against hidden defects, as provided under Luxembourg law.

12.1 Limitation: The Company’s liability is strictly limited to the amount paid by the Client for the order in question.

12.2 Force Majeure: The Company shall not be held liable for any delays or failure to perform its obligations due to causes beyond its reasonable control.

13.1 These Terms are governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg.

13.2 Any dispute arising out of or in connection with these Terms shall fall within the exclusive jurisdiction of the courts of Luxembourg City.
